MUMBAI: In a blow to playback singer, the on Thursday set aside a family court order which dropped proceedings initiated against her by her daughter-in-law. The HC also remanded the matter to the lower court for a fresh hearing. A bench of Justices V K Tahilramani and A R Joshi passed the order while hearing an appeal filed by Paudwal’s daughter-in-law Ambreen Akhoon, against a February 2014 order of the Bandra family court.
Akhoon had filed a petition last year to end her marriage with Paudwal’s son. The petition was filed against her husband and her mother-in-law and she invoked provisions of the Domestic Violence Act against both. She had alleged fraud and non-consummation of a five-year-old marriage and wanted the marriage annulled.
Akhoon’s husband Aditya had denied the allegation of fraud. The family court had declared a 2009 Hindu wedding between her and Paudwal’s son void as Akhoon is a Muslim. The Hindu Marriage Act allows marriage only between a Hindu man and a Hindu woman. The couple then solemnized their marriage under the secular Special Marriage Act, in 2011. The family court held that as the only legally valid marriage and said it was done only “after they realized that their Hindu marriage was void”.

The family court allowed Akhoon to proceed with her annulment plea only under the Special Marrriage Act for the 2011 ceremony. The HC had earlier stayed the proceedings in the family court. Paudwal’s lawyer Chandana Salgaonkar primarily challenged the maintainability of the appeal. She said the family court order itself required Akhoon to amend her petition and delete Paudwal’s name in 14 days, failing which it would stand dismissed, and argued that since she hadn’t done so it was dismissed. But after hearing Akhoon’s lawyer Ahmad Abdi, who argued that the family court’s February order was “completely improper and perverse,” the HC set it aside as being “misdirected’’.
